We respect your privacy and are committed to protecting the personal information you share with us. Please read this Privacy Policy carefully so you understand what information we collect, why we collect it, and the choices and rights you have. By using the Site or our Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Site or the Services.
1. Scope of This Policy
This Privacy Policy applies to information we collect on or through the Site and in the ordinary course of providing our Services, including when you request a free quote, text a photo of your boat, schedule or receive a repair or detailing service, leave a review, or otherwise communicate with us. This policy is designed to address the requirements of the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA/CPRA"), the European Union General Data Protection Regulation ("GDPR"), and the United Kingdom GDPR, as well as other applicable privacy laws. Specific rights that apply to residents of California, the European Economic Area ("EEA"), and the United Kingdom are described in the "Your Privacy Rights" section below.
2. Information We Collect
We collect several categories of information from and about users of our Services. The amount and type of information we collect depends on how you interact with us.
2.1 Information You Provide to Us

Reviews and feedback, any review, rating, testimonial, photo, or comment you choose to share with us or post publicly about our Services.

Usage data, the pages and content you view, the dates and times of your visits, the links you click, the referring website or search term that brought you to us, and how long you spend on the Site.
Approximate location, a general geographic location derived from your IP address, which helps us understand whether visitors are in our Stockton and Delta service area.
Cookies and similar technologies, small data files stored on your device, as well as pixels, tags, and local storage, used to operate the Site, remember your preferences, measure performance, and support analytics and advertising as described in the "Cookies and Tracking Technologies" section.
2.3 Information We Receive From Third Parties
We may receive information about you from third parties, including:
Google Business Profile and Google Maps, when you find us, call, message, request directions, or leave a review through our Google listing.
Social media platforms, such as Instagram and Facebook, when you message us, comment, or interact with our content or advertising.
Quote, scheduling, and shop management tools, such as the form and shop management software we use to receive photos, generate quotes, schedule work, and manage jobs.
Analytics and advertising partners, who provide aggregated insights about how visitors find and use the Site.

3. How We Use Your Information
We use the information we collect for the following business and commercial purposes:

To schedule, perform, document, and follow up on repair, fiberglass and gelcoat, color match painting, and detailing services.
To process deposits and payments, send invoices and receipts, and maintain our business and accounting records.
To communicate with you about your boat, appointment reminders, status updates, and the progress and completion of your job, including by phone, text message, and email.
To request and manage reviews and feedback, and to display testimonials and before/after photos (with your permission where required).
To operate, maintain, secure, and improve the Site and our Services, and to understand how visitors use the Site.
To market our Services to you, including sending promotional messages where permitted and showing you relevant advertising, subject to your choices and applicable law.
To detect, prevent, and address fraud, security incidents, technical issues, and prohibited or illegal activity.
To comply with our legal obligations, enforce our terms, and establish, exercise, or defend legal claims (for example, insurance or warranty matters related to a repair).
We do not sell your personal information for money. As explained in the California section below, certain analytics and advertising practices may be considered "sharing" or a "sale" under California law, and you have the right to opt out.
4. Legal Bases for Processing (EEA/UK Visitors)
If you are located in the EEA or the United Kingdom, we process your personal data only when we have a valid legal basis to do so. Depending on the situation, our legal bases include:
Performance of a contract, to provide a quote, perform a service you requested, and communicate with you about your job.
Legitimate interests, to operate and improve our business and Site, secure our Services, prevent fraud, and market our Services in a proportionate way, provided those interests are not overridden by your rights.
Consent, for certain marketing communications, non essential cookies, and where consent is otherwise required. You may withdraw your consent at any time without affecting processing already carried out.
Legal obligation, to comply with applicable laws, tax and accounting requirements, and lawful requests from authorities.
5. Cookies and Tracking Technologies
We use cookies and similar technologies to make the Site work, to remember your preferences, to measure and analyze traffic, and to support our marketing. The categories we use include:
Strictly necessary cookies, required for the Site to function, such as security, network management, and basic navigation. These cannot be switched off in our systems.
Performance and analytics cookies, help us understand how visitors interact with the Site (for example, which pages are most visited) so we can improve it. These may be set by analytics providers such as Google Analytics.
Functional cookies, remember choices you make to provide a more personalized experience.
Advertising and targeting cookies, set by us or our advertising partners (such as Google and Meta/Facebook) to measure the effectiveness of ads and to show you relevant advertising on other websites and platforms.
You can control cookies through your browser settings, which usually let you refuse or delete cookies. Most browsers also offer a "Do Not Track" setting, although there is no industry standard for how sites must respond. Some browsers and extensions transmit a Global Privacy Control ("GPC") signal; where required by law, we treat a GPC signal from your browser as a valid request to opt out of the "sale" or "sharing" of personal information for that browser or device. If you disable certain cookies, some features of the Site may not function properly.
6. How We Share Your Information
We do not sell your personal information for money. We may disclose your information in the following circumstances:
Service providers and vendors, companies that perform services on our behalf, such as website hosting, quote and shop management software, scheduling tools, payment processing, communications and text messaging providers, email delivery, analytics, and advertising. These providers are permitted to use your information only to perform services for us.
Marketing and analytics partners, such as Google and Meta/Facebook, in connection with measuring and delivering advertising and understanding Site usage. Certain of these disclosures may be considered "sharing" or a "sale" under California law, and you may opt out as described below.
Professional advisors, such as accountants, lawyers, and insurers, where reasonably necessary to run our business or handle a claim.
Business transfers, in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business, your information may be transferred as part of that transaction, subject to this Privacy Policy.
Legal and safety reasons, when we believe disclosure is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our agreements; or to protect the rights, property, or safety of Sergio's Boat Spa, our customers, or others.
With your direction or consent, when you ask us to share your information or otherwise consent to the disclosure.
7. Text Messaging (SMS) and Phone Communications
Because our quote process relies on you texting a photo of your boat, text messaging is central to how we work with you. When you provide your phone number and message us, you agree that we may contact you by text message and phone about your quote, appointment, and service. Message and data rates may apply, and message frequency varies. We do not share mobile phone numbers collected for service or quoting purposes with third parties for their own marketing. You can opt out of text messages at any time by replying STOP to any message from us, or by asking us directly; you may reply HELP for help. Opting out of text messaging may affect our ability to provide quote updates and appointment reminders. Carriers are not liable for delayed or undelivered messages.
8. Third Party Links and Services
The Site may contain links to third party websites, platforms, and services that we do not own or control, such as Google, Instagram, Facebook, mapping services, and our scheduling or quote tools. This Privacy Policy does not apply to those third parties. We are not responsible for the privacy practices or content of any third party site or service. We encourage you to review the privacy policies of every third party service you use.
9. Data Retention
We keep personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide our Services, maintain business and accounting records, resolve disputes, honor warranties, and comply with our legal obligations. When information is no longer needed, we will delete, anonymize, or securely dispose of it. Retention periods vary depending on the type of information and the reason we collected it; for example, we may retain quote and job records and before/after photos longer for warranty, insurance, and portfolio purposes.
10. How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account credentials and communications with us confidential. If we become aware of a security breach that affects your personal information, we will notify you and the appropriate authorities where required by law.
11. Your Privacy Rights
11.1 California Residents (CCPA/CPRA)
If you are a California resident, you have the following rights regarding your personal information, subject to certain exceptions:
Right to know, to request the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we disclose it.
Right to delete, to request that we delete personal information we collected from you, subject to legal exceptions.
Right to correct, to request that we correct inaccurate personal information we maintain about you.
Right to opt out of sale or sharing, to opt out of the "sale" or "sharing" (cross context behavioral advertising) of your personal information. We do not sell personal information for money, but some advertising and analytics activity may qualify as a "sale" or "sharing" under California law.
Right to limit use of sensitive personal information, to the extent we use any sensitive personal information for purposes beyond those permitted by law.
Right to non discrimination, we will not discriminate against you for exercising any of your CCPA/CPRA rights.
In the preceding twelve (12) months, we may have collected the following categories of personal information from the categories of sources described above: identifiers (such as name, phone number, email address, and IP address); customer records (such as contact and billing details); commercial information (such as services purchased or considered); internet or other network activity (such as Site usage data); geolocation data (approximate location); audio, electronic, or visual information (such as photos, videos, and call recordings or voicemails); and inferences drawn to create a profile about your preferences. We disclose these categories to service providers, and we may "share" identifiers and internet activity with advertising and analytics partners for cross context behavioral advertising. We do not knowingly collect or sell the personal information of consumers under 16 years of age.
California's "Shine the Light" law (Civil Code Section 1798.83) permits California residents to request information about our disclosure of personal information to third parties for those third parties' direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
11.2 EEA and UK Residents (GDPR)
If you are located in the EEA or the United Kingdom, you have the following rights regarding your personal data, subject to applicable law: the right to access your data; the right to rectification of inaccurate or incomplete data; the right to erasure ("right to be forgotten"); the right to restrict processing; the right to data portability; the right to object to processing based on legitimate interests or for direct marketing; and the right to withdraw consent at any time where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority. We will not, as a general matter, transfer your data outside your jurisdiction without appropriate safeguards as described below.
12. How to Exercise Your Rights
You may exercise any of the rights described above by contacting us using the details in the "Contact Us" section below. To protect your privacy and security, we may need to verify your identity before fulfilling your request, for example by confirming information we already hold about you. You may use an authorized agent to submit a request on your behalf, in which case we may require proof of authorization and verification of your identity. We will respond to verifiable requests within the timeframes required by applicable law (generally 45 days under the CCPA/CPRA, extendable as permitted, and one month under the GDPR). There is no charge to exercise your rights unless your request is excessive, repetitive, or manifestly unfounded.
13. Children's Privacy
The Site and our Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 16 years of age. If you believe a child has provided us with personal information, please contact us and we will take steps to delete that information.
14. International Data Transfers
We are based in the United States, and we operate primarily in California. If you access the Site or our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. Where required by law, we take appropriate measures, such as standard contractual clauses, to ensure that transfers of personal data receive an adequate level of protection.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the "Last updated" date at the top of this page. If the changes are material, we will provide a more prominent notice where required by law. We encourage you to review this Privacy Policy periodically. Your continued use of the Site or Services after an update becomes effective constitutes your acceptance of the revised policy.
